Ltd.” The terms and conditions contained herein along with the Privacy Policy an agreement regulating our relationship with regard to the use of www.bbakery.com by you. You are hereby advised to read this agreement carefully. If you do not agree to any terms and conditions of this agreement, you are not authorized to access this site. You can use www.bbakery.com Shopping Services if you agree to all the terms and conditions of this Agreement in its entirety. If you accept this agreement, it will be a legally binding agreement between you and “B BakeryFoods Pvt. Ltd.” (for shopping on www.bbakery.com ).

Definitions:

"Agreement" means the terms and conditions as detailed herein including all schedules, appendices, annexures, privacy policy and will include the references to this Agreement as amended, supplemented, varied or replaced time to time. www.bbakery.com or the “Site” means the online shopping portal owned and operated by “B Bakery Foods Pvt. Ltd.”, which provides a platform to the shoppers to buy the products listed on site. "Vendor"/"Seller"/”Affiliate” shall mean the person or any legal entity who offers for sale, sells the products or services on www.bbakery.com . "Customer" / "Buyer" shall mean the person or any legal entity who accepts the offer for sale on site by placing an order for and or purchases any products offered for sale on the site. "User"/ "You" means and includes you and/or any person or an entity including Vendor/Seller/Affiliate using or accessing the services provided on this Site.

Eligibility:

You represent and warrant that you are competent and eligible to enter into legally binding agreement and have the requisite authority to bind the other party to this Agreement. You shall not use this Site if you are not competent to contract under the applicable laws, rules and regulations.

Term of Agreement/Service :

This Agreement shall continue to be in full force and effect for so long as you are using the site. The site provides the online shopping platform wherein the Users can purchase/buy the products and services listed on it pursuant to the terms and conditions set forth below. By clicking on the [Close] button, you are agreeing to use the Services in a manner consistent with and abide by the terms and conditions of this Agreement, our Privacy Policy, and with all applicable laws and regulations. Either you or “B Bakery Foods Pvt. Ltd.” may terminate the agreement at any time, with or without cause. However, “B Bakery Foods Pvt. Ltd.” reserves the right, in its sole discretion, to terminate your access to the products and services offered on the site or any portion thereof at any time, without notice.

To use the Site you will have to register with “B Bakery Foods Pvt. Ltd.”. As a part of registration process you agree to provide “B Bakery Foods Pvt. Online Shopping Platform:

You further agree and undertake that you are accessing the services available on this Site and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction through this Site. “B Bakery Foods Pvt. Ltd.” accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
The address at which delivery of the product ordered by you are to be made should be correct and proper in all respects. After the receipt of payment the Buyer, “B Bakery Foods Pvt. Ltd.” shall arrange for the delivery of the product to the recipient at the shipping address provided by the Buyer.
Any and all orders placed by you on this Site are a firm commitment to purchase and you are obligated to complete the transaction and not contest it in anyway.
Before placing an order you are advised to check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale included in the item's description.
"We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time".

Credit card details:

You agree, understand and confirm that the credit card details provided by you for availing of services on the Site will be correct and accurate and you shall not use the credit card which is not lawfully owned by you. You further agree and undertake to provide the correct and valid credit card details to “B Bakery Foods Pvt. Ltd.”
“B Bakery Foods Pvt. Ltd.” Discount Coupon:

• Discount coupon can be redeemed or availed only on www.bbakery.com
• Discount coupon can be used to purchase all products available at www.bbakery.com except E-Vouchers and Gift Vouchers.
• Only one coupon is applicable for an order and it cannot be clubbed with any other offers.
• Discount is available only on the product price and it is not applicable for shipping/delivery charges.
• Delivery available only in area under Pune Muncipal Corporation.
• Delivery Charges:
  i) Minimum Rs.100 for delivery of a product outside PMC.Exact amount to be conveyed on Phone or email
  ii) Rs. 150 for delivery of product on Night dilivey charges(night delivery starts from 9.00 pm to 6 am).
  
• For availing the discount a customer has to purchase goods worth Rs. 500/- or more as per communicated timely by B Bakery in a single transaction and make a valid payment for it.
• B Bakery reserves the exclusive right to contact the participants of this offer for future promotions / schemes by email / letter/ telephones and the participating consumers agree to receive these calls/communications.
• B Bakery reserves the right to modify, withdraw, alter, extend or discontinue the scheme during the offer period.
• Other general terms mentioned on this page are applicable.
• Discount Coupons can’t be redeemed for cash.
• Offer subject to Force Majeure conditions.
• All terms and conditions of the offer is subject to the exclusive jurisdiction of the Courts of Law at Mumbai.

B bakery Gift Vouchers:

• There are 2 types of Gift Vouchers – Virtual (herein after referred to as “e-Vouchers”) and Physical (herein after referred to as “Gift Vouchers”). The “e-Vouchers” can be redeemed only on www.bbakery.com and cannot be redeemed in any of the Bbakery Cake Shops. Similarly, the “Gift Vouchers” can be redeemed only in any of the Bbakery Cake Shops and but not on www.bbakery.com . A location where a Gift Voucher or an e-Voucher can be redeemed is referred to in these Terms and Conditions as a "Franchisee or Site" respectively.
• An e-Voucher and a Gift Voucher are prepaid payment devices that come with a PRODUCT EXCHANGE. They are not credit Vouchers, charge Vouchers or debit Vouchers.
• Gift Vouchers (both e-Vouchers as well as Gift Vouchers) cannot be purchased by using Discount Coupon Codes.
• Every e-Voucher carries a unique “e-Voucher Code” which needs to be submitted while redeeming it on www.bbakery.com
• Similarly, every Gift Voucher has to be physically submitted to Bbakery Franchisee in original in order to redeem it.
• To use a Gift Voucher or an e-Voucher at a Franchisee or on Site respectively, present them at the time of payment. They entitle the bearer to exchange it for only the value they carry. The bearer of a Gift Voucher has to select a product from amongst the ones available with the Franchisee or on Site at the time of exchange.
• Bbakery is not responsible for lost, stolen, or misused Gift Voucher or an e-Voucher. Risk of loss passes to the purchaser of the a Gift Voucher or an e-Voucher and upon handing over of the a Gift Voucher or an e-Voucher to the recipient.
• A Gift Voucher or an e-Voucher has an expiration date of 12 MONTHS from the date of issue.
• While there is "valid through" period, the entitlements on a Gift Voucher or an e-Voucher do not expire. You may not use a Gift Voucher or an e-Voucher after the "valid thru" period. If the a Gift Voucher or an e-Voucher remains unutilized after the "valid thru" period, contact us at the Customer Service Number (91-8411881150) to obtain a replacement a Gift Voucher or an e-Voucher or for instructions on how to utilize the unused a Gift Voucher or an e-Voucher. We reserve the right to decline to issue a replacement a Gift Voucher or an e-Voucher.
• A Gift Voucher or an e-Voucher is nonrefundable and cannot be redeemed for cash value.
• B bakery reserves the right to cancel an issued a Gift Voucher or an e-Voucher and/or request alternative forms of payment if a fraudulently obtained a Gift Voucher or an e-Voucher is either redeemed through the www.bbakery.com website and/or is used to make purchases in B bakery Exclusive Cake Shops.
• IN THE EVENT A GIFT VOUCHER OR AN E-VOUCHER IS NON-FUNCTIONAL, THE RECIPIENT AND PURCHASER'S SOLE REMEDY, AND B BAKERY SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH A GIFT VOUCHER OR AN E-VOUCHER.
• In case if any Franchisee refuses to honor the Gift Voucher or for any other problems if a Franchisee or the Site fails to honor a Gift Voucher or an e-Voucher, please call the Customer Service Number (91-8411881150) to report the incident.
• We may change the terms of, or add new terms to, these Terms and Conditions at any time, with or without cause, and without giving you notice. In addition, we may suspend, cancel, add, modify or delete any feature offered in connection with your Gift Voucher or an e-Voucher at our sole discretion at any time, with or without cause, and without giving you notice. The Gift Voucher or an e-Voucher is B bakery property.
• A Gift Voucher or an e-Voucher and their use are subject to the B bakeryTerms of Service and Privacy Policy, which are incorporated herein above. In the event of a conflict these a Gift Voucher or an e-Voucher terms and conditions shall control.

Suspension due to non-compliance with Agreement :

Notwithstanding other legal remedies that may be available to B Bakery, Bbakery may in its sole discretion limit User activity by immediately removing User listing either temporarily or indefinitely or suspend or terminate User membership, and/or refuse to provide User with access to the Site,

• If the User is in breach any of the terms and conditions of this Agreement;
• If the User has provided wrong, inaccurate, incomplete or incorrect ination;
• If your actions may cause any harm, damage or loss to the other Users or B Bakery.

Illegal and/or unauthorized use of the Site, including unauthorized framing of or linking to the Site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal and injunctive redress.

Indemnity

User agrees to defend, indemnify and hold harmless Bbakery , www.bbakery.com , its employees, directors, officers, agents and their successors and assigns and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon the use of User's actions or inactions, including but not limited to any warranties, representations or undertakings or in relation to the non-fulfillment of any of its obligations under this Agreement or arising out of the User's infringement of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights.
This clause shall survive the expiry or termination of this Agreement.

Governing Law and Jurisdiction:

This website is created and controlled by B bakery Foods Pvt. Ltd. in Pune, India and the laws of India shall apply. This agreement is governed and construed in accordance with the Laws of Union of India. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Pune, Maharashtra, India, in all disputes arising out of or relating to the use of the Bbakery Sites. Use of the Bbakery Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree to indemnify and hold Bbakery its subsidiaries, affiliates, directors, officers and employees, harmless any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on the Bbakery Site.

In addition, Bbakery  owns a copyright on this site as a collective work or compilation, and in the selection, coordination, enhancement, and arrangement of the site's content. General :

In the event that any provision contained in these Terms and Conditions is held by a court of competent jurisdiction to be contrary to any law, the remaining provisions of these Terms and Conditions will remain in full force and effect. No joint venture, partnership, employment, or agency relationship exists between you and Bbakery as a result of these Terms and Conditions or your use of this site. The waiver by Bbakery of one breach or default under these Terms and Conditions shall not constitute the waiver of any subsequent or other breach or default.

Important Notice to Webmasters :

Regarding the use of trademarked names in meta tags and/or hidden text, we have a no-tolerance policy. The use of trademarked names in metatag keywords is trademark infringement, and the use of trademarked terms in page text, meta tags, and/or hidden text for purposes of gaining higher rankings search engines is unfair competition.
Linking to any Bbakery web page is prohibited absent express written permission Bbakery. Framing the Bbakery website with links, advertisements and/or other ination not originating the Bbakery website is expressly prohibited.

Shipping Policy :

1. We CANNOT commit any fix time for delivery. Deliveries will be made between 12 noon to 9 pm on the given date.
2. Same Day Delivery option is available only for Pune locations and order received till 6 pm will be delivered till 9 pm.
3.Mid-night Delivery will be made between 9.0 pm to 3.am on mentioned / asked delivery date (not yet started).
4.Products categorised in Gifts section like Premium Chocolates, Premium Assortment, Collectible Gifts, Greeting Cards and Marvel Cakes, cookies, confectionaries are delivered by courier. We try our best to deliver these products on the delivery day. However, in unavoidable circumstances or wrong pin code these products may reach before or after delivery date mentioned.
5. Flowers are delivered seperately by the vendors associated with us.
6. The delivery will NOT be redirected / redelivered to any other address in any circumstance.
7. The selected product will be delivered only in the city it is mentioned as “available” on this Site.
8. Delivery might happen through Non-Bbakery outlet in case of some urgency or non-availability of particular product / Bbakery Outlet in vicinity of the delivery location.
9. We will attempt delivery of the items ONCE. In case the delivery is not executed during the attempt, the customer shall still be charged for the order and no redelivery will be possible. We will consider the order as “executed” in the following cases :

• Delivery not done due to wrong address.
• Recipient not available.
• Premises locked.
• Wrong phone or Cell or Extension number/ not working / no reply or not connecting / reachable and delivery is not done.
• Recipient refused the products.
• Delivered the product at the Gate / Reception / Neighbour.

10. Please note that Cakes, Chocolates, Cookies, Flowers and other perishable products are sourced locally at the delivery location & will be hand delivered.
11. No Deliveries on prescribed holidays.
12. The images displayed on the site are indicative in nature. Though we do our best but actual product may vary in appearance, shape or design for reasons that may vary.
13. We reserve the right to substitute the products with equal or higher value in case of non availability of the desired product.
14. In case of floods / Heavy Rains / National Bandh we reserve the right to reschedule the delivery for another date.
15. No change in instructions can be entertained after placing the order.
16. Orders once placed cannot be cancelled.
17. In case the product is not delivered due to any of the above reasons, the update will be available on the website and the same can be collected the delivering Bbakery outlet only on the same, details of which are available with our customer support team.
18. We will not entertain any complaint for any product after 3 hours of the time of delivery.
19. Proof of delivery will be provided in case of any dispute in delivery.
20. For traded commodities, respective brand owners will be responsible for the quality of product. 21. Delivery of certain branded items may not be possible / delayed under certain un-controllable
circumstances such as product is not available in the market or discontinued by the manufacturer. In such cases, similar product, nearest to the description equal or higher in value shall be delivered.
22. No Complimentary product will be given with any of the placed order.
23. If the products are in outskirts of serviceable area it will take more than 48 hrs delivery time.
24. No modification is possible once the date is specified.
25. Cake and Non Cake products outside Pune location are not delivered.
26. Offers are valid till stock lasts. We shall deliver the product as per the delivery mode specified.

Terms & Conditions for Reward Program :

1. Customers will be automatically entered into Bbakery Rewards Program once they create a bbakery.com account.
2. Gift Vouchers and eVouchers cannot be purchased using the points;
3. The Reward Points cannot be transferred, exchanged or encashed
4. The Reward Program can be terminated by Bbakery any time during its operation without giving prior notice to anyone
5. Further, by accepting the Rewards Points, each customer agrees to release and hold harmless Bbakery, its franchisees, licensees, affiliates, subsidiaries, merchant partners, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, use or misuse of the Reward Points or participation in any Reward Program related activity. This Program is void where prohibited by law.
6. Bbakery reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Reward Program; to be in violation of the Terms & Conditions of the web site, to be acting in violation of the sites Policies and Procedures; or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
7. Any use of robotic, automatic, macro, programmed or like entry methods are strictly prohibited and use of such entries by such methods will lead to disqualification from the Rewards Program.
8. In the event of a dispute as to entries submitted by multiple users having the same account, the authorized subscriber of the account used to enter the Reward Program at the actual time of entry will be deemed to be the user and must comply with these rules.
9. Bbakery will prosecute any fraudulent activities to the full extent of the law.

Limitations of Liability & Disputes for Rewards Program :

We reserve the right in our sole discretion at any time and without prior notice to you to add to, remove or otherwise change these terms, including without limitation: changing the amount of the referral bonus, modifying how you may earn and spend referral credits, modifying the duration and expiration of referral points, that you may earn, and discontinuing the bbakery.com “Triple dhamaka program” entirely.
We will post an updated version of these terms on the bbakery.com website, and you will be deemed to have accepted such changes by continuing to use the bbakery.com website or the bbakery.com “Register Now & Earn Up to Rs.200” after the date such changes are posted All the schemes are subject to Force Majeure conditions.
